These Terms & Conditions apply specifically to service packages offered by FGX Technologies PLT ("FGX", "we", "us"). By purchasing or subscribing to any package, you agree to these terms, which cover One-Time Projects, Monthly Support (Ops Care), and Dev Flex Plans.

1. Packages Covered
This agreement applies to:
- One-Time Projects: Lite, Pro, Premium
- Monthly Plans: Ops Care (Basic, Full, Hosting Only), Dev Flex (Mini, Standard, Pro)
2. Scope & Delivery
- Package scope is defined by the selected tier and the written quotation or proposal.
- One revision cycle is included (limited to text/image changes or layout tweaks).
- You must submit all required content (text, branding assets, images) before development begins.
- Timelines are estimates and may be extended due to delayed content or feedback.
- Urgent delivery may be available with a 20% fast-track surcharge, subject to availability.
3. Ownership & Access
- You own all final deliverables (website, source code, admin panel) after full payment is received.
- FGX retains the right to reuse internal templates, components, or frameworks.
- Admin panel or CMS access is granted based on the selected package.
- Hosting or migration assistance is available for RM300–RM500, depending on scope.
4. Payment Terms
One-Time Projects:
- 50% deposit to begin
- 50% due upon completion or before handover/go-live
Monthly Plans:
- Invoiced at the start of each billing cycle, based on your plan activation date
- 14 days' notice is required to pause or cancel
- Payments overdue by 14+ days may result in access suspension or delivery delays
5. Dev Flex Conditions
- Dev time resets monthly and does not carry over.
- Tasks are scheduled based on availability and client priority.
- Large features, third-party integrations, or automation may require a separate quote.
- Tier changes (e.g., Mini → Standard) require 14 days' notice.
6. Ops Care Conditions
- Covers maintenance, edits, and support, not new feature development.
- Hosting-only plans apply to static or frontend-only sites (no backend/database support).
- Each plan includes 1 emergency recovery per year (e.g. malware, accidental deletion).
CMS edit limits vary by plan:
- Basic: Light content and banner updates
- Full: Frequent admin edits and dashboard support
7. Refunds & Cancellations
No refunds will be issued for:
- Completed or partially completed projects
- Monthly plans already started or in progress
- Dev Flex plans may be cancelled with 14 days' notice before the next billing cycle.
- We encourage early communication and will handle disputes professionally.
8. Automation & Add-Ons
- Automation features (e.g. WhatsApp alerts, email triggers) are available as paid add-ons.
- Pricing starts from RM500 per flow, depending on complexity.
- WhatsApp-based automation requires a verified WhatsApp Business API account.
- Not included in base packages unless explicitly stated in writing.
9. Acceptable Use
- You may not use FGX-built systems or websites for illegal, malicious, or unethical activities.
- We reserve the right to pause support or services if misuse is detected or reported.
10. Limitation of Liability
- FGX is not liable for third-party failures (e.g. hosting, plugin outages, domain issues).
- We are not responsible for indirect losses (e.g. downtime, data loss, missed sales).
- Liability is limited to the total amount paid for the project or billing cycle.
11. Support Policy
- Ops Care – Basic: Response within 2–3 business days via WhatsApp or email
- Ops Care – Full: Priority response within 1 business day + monthly strategy call
Support does not include:
- Third-party ad tools (e.g. Facebook/Google Ads)
- Social media management
- Staff training sessions (unless scoped separately)
12. Governing Law
- These Terms are governed by the laws of Malaysia.
- Any disputes will be handled through good-faith resolution or arbitration in Kuala Lumpur, Malaysia.
13. Scope Limit Summaries (Quick Reference)
One-Time Packages (Lite, Pro, Premium):
- Includes fixed deliverables only (pages, forms, tools)
Does not include:
- Logo/branding design
- Copywriting or marketing content
- Product photography
- Ad setup or social media management
- Post-launch support (covered under Ops Care or Dev Flex)
Ops Care Plans (Basic, Full):
- Meant for maintenance and edits, not new features
- Hosting-only plan is for static sites only
Dev Flex Plans (Mini, Standard, Pro):
- Dev time resets monthly
- Scope limits defined in plan and adjusted via SoW if needed
- Additional days and upgrades available on request
